In alignment with Board Policy, District employees with instructional expertise, as well as parents or guardians of District students, have the right to request a reconsideration of any library material in the District's collection. Titles may be challenged if an individual believes the material does not meet the standards outlined in Board Policy EFB. The procedures for submitting a reconsideration request are detailed within this policy.
Bastrop ISD is obligated to uphold the First Amendment rights of its students. According to established Supreme Court rulings, the District cannot remove a library book without conducting a thorough review of the material. The District’s policy ensures that a proper evaluation is completed before any title is removed, in compliance with the First Amendment. At the same time, the policy ensures that educationally unsuitable materials, such as those deemed pervasively vulgar, are removed following the review process. For more details on the legal framework, refer to Board Policy EFB.
As stated in Board Policy EFB, "access to a challenged material shall not be restricted during the reconsideration process, except the District may deny access to a child if requested by the student's parent or guardian."
